State Comptroller Thomas DiNapoli says the New York Racing Association has agreed to comply with his subpoena and turn over its financial records.
NYRA had previously said that the comptroller’s office did not have the authority to audit its franchise.
DiNapoli wants to know what happened to state money NYRA received two years ago. In 2008, the state forgave $200 million in debt and tax liens and gave the group another $105 million to keep operating.
The group, which runs the Aqueduct, Belmont, and Saratoga race tracks, says it is strapped for cash and may have to cancel the Belmont Stakes, the third leg of racing’s Triple Crown, next June.
