Democrats are heading to court in New York’s 23rd House race, seeking to have voting machines impounded on election night.
June O’Neill, executive committee chairwoman of the state Democratic Party, says they have obtained an order to show cause requiring it. Parties usually seek to impound machines the day of an election in a close race, so campaigns involved can watch the process of double checking ballots.
O’Neill says they’re going to court early because a portion of the district is requiring people who registered to vote in time for federal elections, but not in time for state and local elections, to vote on ballots – not on the pull-lever machines.
O’Neill says they want to act now to ensure those votes are counted the night of the election.
That would become an issue if the three-way Nov. 3 contest is close
