Hiram Monserrate’s Fiancee Asks Judge to Lift Protection Order

State Sen. Hiram Monserrate’s fiancée is asking a judge to lift an order of protection, despite his misdemeanor assault conviction.

In a letter to state Supreme Court Justice William Erlbaum, Karla Giraldo’s attorney says the couple wants to resume their “intimate relationship” as soon as possible.

Attorney Glenn Marshall says the basis for the order, the charge that Monserrate intentionally injured Giraldo, was decided in the politician’s favor.

Monserrate was acquitted of a felony; both said a gash on Giraldo’s face was accidental. He was convicted of the misdemeanor for dragging her.

Some fellow Democrats have called for his resignation.

Monserrate could face up to a year in jail at sentencing Dec. 4. The defense deems jail unlikely.
