Councilman Dennis Gallagher rape charges dismissed

Councilman Peter Vallone Jr. came to Room 9 in City Hall to spread the word that rape charges against his Queens colleague, Republican Councilman Dennis Gallagher, have been dismissed.
Vallone called the married Gallagher’s decision to have sex with a woman in his Middle Village office last summer “unwise,” but added: “He did not commit the crime of rape…Justice is now done.”
Gallagher had repeatedly insisted that he had consensual sex with the 52-year-old woman he met July 9 at Danny Boy’s, a local bar. But she (and the DA) disagreed. A Queens grand jury indicted Gallagher on 10 counts of rape, criminal sexual acts and assault in August.
Gallagher is barred from running for re-election in 2009 due to term limits. His indictment threw the Queens County GOP into a tizzy, accelerating speculation about who would run to succeed him.
